Welcome to the website of Premiere Floor Plans (“Company,” “we,” “our,” or “us”). By accessing this website, booking a service, submitting project information, making payment, or using our services, you agree to these Terms of Use.
Premiere Floor Plans currently operates as a sole proprietorship. If the business structure changes in the future, these Terms of Use may be updated.
1. Services and Purpose
Premiere Floor Plans provides real estate visualization and marketing deliverables, including 2D floor plans, 3D floor plans, 3D interactive walkthrough links, 3D model web links, pre-construction visualizations, listing graphics, and digital presentation materials.
All services are intended for marketing, visualization, presentation, and listing support purposes only.
2. Marketing and Visualization Disclaimer
Floor plans, 3D visuals, renderings, interactive links, graphics, and marketing materials are not architectural drawings, engineering plans, construction documents, appraisal documents, survey documents, permit-ready plans, or legal property records.
3. Measurement Disclaimer
All dimensions, room labels, layouts, and square footage references are approximate. Clients, buyers, sellers, agents, builders, and third parties are responsible for independently verifying all property details.
4. On-Site Property Access
Certain services require an on-site visit to measure, scan, photograph, or collect information from a property.
The client is responsible for ensuring that Premiere Floor Plans has legal permission to access the property at the scheduled appointment time. The client is also responsible for providing accurate access instructions, lockbox information, gate codes, contact information, or arranging for an authorized person to provide entry if required.
Premiere Floor Plans reserves the right to refuse entry, stop work, or reschedule an appointment if property conditions are unsafe, inaccessible, hazardous, aggressive animals are present, access cannot be obtained, or conditions prevent the service from being completed safely and accurately.
The client is responsible for securing pets and informing Premiere Floor Plans of any known hazards, restricted areas, security systems, fragile items, valuables, or special access requirements before the appointment.
Premiere Floor Plans is not responsible for delays, additional travel, rescheduling costs, or incomplete services resulting from denied access, inaccurate information, unsafe conditions, or the absence of an authorized person when assisted entry has been requested.
5. Client Responsibility for Property Access
The client confirms that they have the authority to grant access to the property and authorize Premiere Floor Plans to enter the property for the scheduled appointment.
The client agrees to hold Premiere Floor Plans harmless from claims, disputes, or issues arising from unauthorized access instructions, incorrect access information, tenant disputes, owner disputes, or access permissions provided by the client.
6. Property Conditions and Liability
Premiere Floor Plans will exercise reasonable care while performing services at a property.
Clients are responsible for notifying Premiere Floor Plans of any known hazards, fragile items, restricted areas, security systems, pets, valuables, or special property conditions before the appointment.
Premiere Floor Plans is not responsible for pre-existing property conditions, concealed defects, structural issues, unsafe conditions, or hazards that are not disclosed prior to the appointment.
Clients agree that normal movement through the property, including measuring, scanning, photographing, and documenting spaces, is necessary to perform the requested services.
7. Payment Terms
Payment is required before work begins unless otherwise agreed in writing. Bookings and project reservations are not confirmed until payment is successfully completed. Premiere Floor Plans does not currently offer Net 30 billing, unpaid purchase order terms, or delayed payment terms.
Refunds may be limited or unavailable once work has begun, an on-site appointment has been completed, digital files have been created, project labor has been performed, or third-party hosting or processing costs have been incurred.
Payment processing fees, scheduling fees, hosting costs, and third-party platform fees may be non-refundable.
8. Cancellations and Rescheduling
Appointments may be rescheduled or canceled by the client subject to the cancellation policy provided during booking.
Premiere Floor Plans reserves the right to reschedule appointments due to weather, unsafe conditions, access issues, illness, emergencies, travel disruptions, or other circumstances beyond reasonable control.
9. Client-Provided Materials
Clients may provide floor plans, photos, videos, drawings, sketches, references, 3D models, logos, or other project materials. The client confirms they have the right to provide those materials for use in the project.
Premiere Floor Plans is not responsible for copyright claims, licensing issues, inaccurate information, or third-party disputes related to materials supplied by the client.
10. Intellectual Property
All floor plans, 3D visuals, renderings, graphics, layouts, marketing materials, and deliverables created by Premiere Floor Plans remain the intellectual property of Premiere Floor Plans unless otherwise agreed in writing.
Purchasing a service does not transfer ownership of original design files, source files, project files, templates, working files, software files, or intellectual property.
11. Client Usage License
Clients receive a limited, non-exclusive license to use final delivered files for marketing, advertising, listing, leasing, sales, presentation, and promotional purposes related to the specific property or project.
This includes MLS listings, Zillow, Redfin, Realtor.com, brokerage websites, printed flyers, social media, email marketing, open house materials, builder presentations, leasing presentations, and property marketing related to the specific project.
12. Restricted Use
Clients may not resell the deliverables as a standalone product, claim authorship, reuse the deliverables for unrelated properties, remove included branding, use the deliverables to create competing services, or use the deliverables for construction, permitting, engineering, legal, appraisal, or survey purposes.
13. Editing and Alterations
Clients may resize, crop, upload, print, or post final deliverables for normal marketing use. Clients may not materially alter, redraw, relabel, manipulate, remove branding from, misrepresent, or have another company edit the deliverables in a way that changes the meaning, accuracy, appearance, or authorship of the work without written permission.
14. Portfolio Use
Premiere Floor Plans may display completed work on its website, social media, portfolio, advertisements, brochures, sample pages, and other promotional materials unless the client requests confidentiality in writing before the project begins.
15. File Delivery
Final files may be delivered by email, website download page, cloud storage link, file-sharing platform, or another digital delivery method. Clients are responsible for downloading and saving their final files after delivery.
16. Interactive Web Links and Hosting
Interactive 3D walkthrough links or 3D model web links may depend on third-party hosting platforms. Hosting length, renewal options, browser performance, loading speed, and device compatibility may vary depending on the service purchased and the platform used.
17. No Guarantee of Results
Premiere Floor Plans does not guarantee that any listing, property, rental, development, or project will sell, lease, receive more showings, receive more offers, or achieve a specific marketing result.
18. Limitation of Liability
Premiere Floor Plans is not liable for damages, losses, delays, claims, missed sales, listing issues, construction decisions, buyer decisions, third-party disputes, property access issues, injuries caused by unsafe property conditions, unauthorized access claims, tenant disputes, owner disputes, pre-existing property conditions, concealed hazards, approximate measurements, client-provided materials, third-party platform issues, file delivery problems, or unauthorized editing or redistribution.
19. Governing Law
These Terms of Use are governed by the laws of the State of Washington, United States.
